Agreement

By placing an order with Gemma Flowers (Gemma Flowers LLC), browsing gemmaflowers.com, or using our ordering channels (website, phone, SMS, DoorDash, or authorized agent platforms), you agree to these Terms of Service. If you do not agree, please do not place an order.

About Us

Gemma Flowers is a florist based in Irvine, California, serving Orange County. Studio: 141 Mirth, Irvine, CA 92618. Customer pickup is at CUP by Blue Hummingbird Coffee, 385 Novel STE B3, Irvine, CA 92618 (meet outside in front of the coffee shop). We are not a walk-in flower storefront.

Orders & Availability

• Website and authorized channels may accept orders 24/7.
• Fresh flowers: same-day fulfillment only when ordered by 8:00 PM Pacific Time on a day we can fulfill; orders after that cutoff are next-day for fresh flowers unless we confirm otherwise.
• Named catalog arrangements are sold as described. Custom requests may be quoted separately.
• Product photos are representative; natural variation in blooms is expected.

Pricing & Payment

• Prices are shown in USD and may change without notice until an order is paid.
• Payment is processed securely through Stripe (including Stripe Checkout / Link where offered). We do not store full card numbers on our servers.
• Delivery fees, taxes, and tips (if any) are shown at checkout or confirmed before payment when ordering by phone.

Delivery & Pickup

• Delivery is available to eligible Orange County ZIP codes we serve. Fees and eligibility are confirmed at checkout or when we quote.
• Customer website pickup is CUP only (address above). DoorDash / Dasher pickups use our studio address when applicable.
• Accurate recipient name, phone, address, and delivery instructions are your responsibility. We are not responsible for failed delivery caused by incorrect information, inaccessible locations, or recipient refusal.

Cancellations, Returns & Refunds

Perishable flower arrangements are generally sold as-is. Our Return & Refund Policy applies in full, including quality concerns within 48 hours, cancellations before preparation, and that we do not issue refunds or replacements except as stated there.

Agent / Platform Orders

If you order through an authorized AI agent or connector platform (for example Meta Muse), these Terms still apply to the underlying Gemma Flowers order. The platform's own terms may also apply to your use of that platform. Payment may be completed via Stripe Checkout / Link when directed.

Intellectual Property

Site content, product names, photos, and branding are owned by Gemma Flowers LLC or our licensors. You may not copy or reuse them for commercial purposes without permission.

Limitation of Liability

To the fullest extent permitted by law, Gemma Flowers LLC is not liable for indirect, incidental, or consequential damages arising from orders or use of the site. Our total liability for any order is limited to the amount you paid for that order.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Venue for disputes is Orange County, California, unless applicable law requires otherwise.

Changes

We may update these Terms by posting a new version on this page and updating the "Last updated" date. Continued use after changes means you accept the updated Terms.
